A European Initiative
The day's data protection is celebrated every year on 28 January. It was launched in 2007 at the initiative of the Council of Europe and relayed by the European Commission. It is now celebrated around the world as "Data Privacy Day".
This event aims to make the general public understand what data is collected and processed, why, and above all what are the rights of Internet users during this process.
January 28 was chosen because it is the anniversary of Convention 108 of the Council of Europe, which since 1981 is the reference legal instrument for data protection in Europe and beyond. Unfortunately, to date, only 44 states in the world
A Major Issue
The Data Protection Day wishes to educate the general public on:
- the importance of the protection of personal data
- the importance of respect for private life.
With the rise of new technologies, a lot of personal information is recorded every day in files, communicated to third parties, and reconciled with other data for various purposes.
Good Practices to Know
Data Protection Day is an opportunity to recall the work accomplished in France by the National Commission for Computing and Liberties (CNIL).
The CNIL recently published documentation on its site:
- to help website managers to fulfill their obligations in terms of processing personal data
- to help consumers protect their data on the Internet and in particular when shopping online.
In the context of e-commerce, personal data and cookies should only be used by merchant sites for functional purposes. For any other use, the prior consent of the Internet user is required. The same applies to the use of an email address for advertising purposes, for example for sending a newsletter.
To respect the privacy of individuals, merchant sites have the obligation to:
- declare to the CNIL the customer file that they create from the information collected on their site
- inform Internet users of their rights (in particular to 'existence of a right of access/rectification and erasure of his information)
- guarantee the confidentiality of the information collected
